You don’t need to be indicted to be arrested/ charged with a crime. He HAS been arrested and is out on bail. The state of Illinois has to sort out exactly what his LEGAL status and authority is. However, you are not accurate in saying that he has not been indicted.

I disagree with your comment as to being derelict in not appointing someone. His PRIMARY responsibility is to act with the good of the state in mind. He is completely aware of the furor and issues over any person he appoints. If he gave a damn about the well being of the state.. he would have at least taken a temporary leave, and allowed someone else to make the choice, to be free from ANY questions.
